Part 1 - Reasons for being evicted from an Arizona apartment or rental

According to ARS 33-1476 you may be evicted from an Arizona apartment if:

There is a material noncompliance by the tenant with the rental agreement, the landlord shall deliver a written notice to the tenant specifying the acts and omissions constituting the breach and that the rental agreement will terminate upon a date not less than thirty days after receipt of the notice if the breach is not remedied in fourteen days. If the tenant remedies the situation within the time specified in the notice, the landlord shall issue a notice to the tenant releasing the tenant from the termination of rental agreement notice.

Landlords must prove "Good Cause" if not renewing or terminating an Arizona tenants lease

ARS 33-1476 States this:
The landlord may not terminate or refuse to renew a tenancy without good cause. "Good cause" means:

1. Noncompliance with any provision of the rental agreement.

2. Nonpayment of rent.

3. Change in use of land.

4. Clear and convincing evidence that a tenant has repeatedly violated any provision of this chapter and established a pattern of noncompliance with such provisions.

Paying Finders Fees to Tenants in Arizona apartments

Arizona Military Orders Enable Soldiers to Break their Lease

According to Arizona Revised Statutes 33-1413, A landlord shall not prohibit a tenant who is a member of the armed forces of the United States from terminating a rental agreement with less than two weeks' notice to the landlord if he receives reassignment orders which do not allow such prior notification.

Security Deposits for Apartments in Arizona

As referenced in Arizona Revised Statutes 33-1431, A landlord shall not demand or receive as security, however denominated, prepaid rent in an amount or value in excess of two months' rent. This subsection does not prohibit a tenant from voluntarily paying more than two months' rent in advance.

The landlord shall pay not less than five per cent annual interest on any damage, security, cleaning or landscaping deposit required by a landlord of a tenant. The landlord shall either pay the interest annually or compound the interest annually.

Upon termination of the tenancy, any security deposit, less any accrued rent and damages, if applicable, shall be returned to the tenant within fourteen days. The security deposit may be applied to the payment of accrued rent and the amount of damages which the landlord has suffered by reason of the tenant's noncompliance with section 33-1451 if it is itemized by the landlord in a written notice delivered to the tenant together with the amount due within fourteen days of termination of the tenancy and delivery of possession by the tenant.

If the landlord fails to comply with subsections B and C of this section the tenant may recover the property and money due the tenant together with damages in an amount equal to twice the amount wrongfully withheld.

This section does not preclude the landlord or tenant from recovering other damages to which he may be entitled under this chapter.

The holder of the landlord's interest in the premises at the time of the termination of the tenancy is bound by this section.

The amount of any security deposit shall not be changed after the tenant executes the initial rental agreement.

Apartment Vacancies highest they have been in 30 years

According to the Phoenix Biz Journal, apartment vacancies are the highest they have been in 30 years. As a result, there is much less building occurring which results in less construction jobs. Although, according to the Associated General Contractors, construction jobs are still being lost on a monthly basis, it seems the losses are slowing when compared to last year. This may be good news for current apartment homes in Arizona because less building means less competition. As for now, I suspect the apartment management firms will continue to offer great specials and lower rents until the occupancy levels increase.
